These Terms & Conditions ("terms") are a legal agreement between you and Tweed Valley Digital ("we", "us", "our"), the operator of The Whisky Cabinet website and application (the "Service"), including the curated partner collections, the Members' Club, the community pages, the bottle scanning features and all other content and functionality made available through it.

By accessing or using the Service, creating an account, joining the Members' Club, entering the members' giveaway, or posting content, you confirm that you have read, understood and agree to be bound by these terms. If you do not agree, you must not use the Service.

Our Privacy Policy forms part of these terms and explains how we handle personal information.

The Service is intended only for adults of legal drinking age in the country from which they access it — in the United Kingdom, 18 years or over. By using the Service you confirm that you meet that requirement.

We operate an age-verification screen on entry. Circumventing or attempting to circumvent it is a breach of these terms. We do not knowingly allow access to, or collect information from, anyone under the legal drinking age, and we may close any account we reasonably believe belongs to such a person.

Alcohol is not sold through the Service. All drinks are served on the premises of the relevant venue, subject to that venue's licensing conditions and its responsible-service policies, and we may refuse service where the law or a venue's policy requires it.

Some parts of the Service require an account, and the Members' Club requires both an account and an active membership. You agree to provide accurate information, to keep your login credentials confidential, and to tell us promptly if you believe someone else has access to your account.

You are responsible for activity carried out through your account. Accounts are personal to you: they may not be sold, shared, transferred or used on behalf of anyone else. We may refuse, suspend or close an account where these terms are breached, where required by law, or to protect the Service, its members or any venue.

You agree not to:

• use the Service for any unlawful, fraudulent or misleading purpose;
• copy, scrape, harvest, crawl or systematically extract content or member data, or access the Service with automated tools, without our written permission;
• interfere with, overload, probe, disrupt or attempt to gain unauthorised access to the Service, its servers, or another user's account;
• upload viruses, malicious code, or content that infringes anyone's rights;
• impersonate any person, venue or organisation, or misrepresent your connection to one;
• use the Service to advertise or sell alcohol, or to promote irresponsible, rapid or underage drinking;
• use another member's content or images without their permission.

The Service provides curated information about whiskies, distilleries, regions, tasting notes, flavour profiles, prices and flights, together with explanatory diagrams and guides. This material is provided for general interest and guidance only. It is not professional, medical, dietary, allergen, investment or purchase advice, and it is not a substitute for the label on a bottle, the information provided by the distillery, or the advice of venue staff.

Whisky is made in batches and can vary between bottlings. Expressions, ages, cask maturities, strengths, availability and prices change, and any indication of stock, price or availability shown on the Service is indicative rather than a binding offer.

The Service showcases curated collections for partner venues, hotels and bars (a "venue") — for example the SCHLOSS Roxburghe collection. Each venue is an independent business. Venues are responsible for their own stock, pricing, service measures, licensing, staff training and the experience they provide on their premises.

Venue content, logos, names and imagery are used with the venue's permission and remain the property of the venue or its licensors. Inclusion of a venue does not make us a party to any contract between you and that venue, and does not amount to an endorsement by the venue of any other part of the Service.

Venue dashboards and their content are provided to the venue for its own use. Venue staff are responsible for keeping their own details accurate and for the security of their access credentials.

Members receive a personal invitation code and can invite friends to join the club. Where a friend joins with your code and their membership becomes paid and active, you may receive a free month and they may receive a free month, as described at the time. Free months have no cash value, cannot be transferred or exchanged for cash, and are credited only once per invited friend.

Referrals must be genuine: you may not invite yourself, create duplicate or false accounts, use disposable or fabricated identities, advertise your code in paid or bulk channels, or otherwise abuse the programme. We may withhold or reverse any reward obtained in breach of this section, and we may withdraw or change the programme at any time.

From time to time we run a giveaway for members. The following applies unless we state otherwise in the details shown with it.

• Who may enter: active members of the Members' Club who are of legal drinking age. One entry per member. Entry is included with membership at no extra charge, and we may also accept a written request for an entry from a member who cannot use the claim feature.
• The prize: the prize is a bottle (or bottles) of whisky, or a voucher to be spent with us or a partner venue to the same value. The value and type of the prize grows as the club grows, and is determined by us at the time of the draw. Prizes are personal, non-transferable, and no cash alternative is offered except that a voucher may be given in place of a bottle. Any bottle prize is subject to availability and to age-verification on delivery or collection.
• The draw: the draw is made by us, at our discretion, from the entries claimed. The winner is contacted using the contact details on their account and must respond within 14 days, failing which we may draw another entry. Club numbers may be used to identify entries.
• Our discretion: we may amend, suspend, postpone or end the giveaway at any time, including where errors, technical faults or abuse occur, and we may disqualify any entry that breaches these terms. Our decision on all matters relating to the giveaway is final.
• Not sponsored: the giveaway is run solely by us and is not sponsored, endorsed or administered by any distillery, venue or other third party.
• Tax: any tax due on a prize is the winner's responsibility.

You may be able to post stories, notes, reviews, comments, photographs and images ("your content") on the Service — in the members' area and in the public community area. You keep ownership of your content.

By posting content you grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and distribute that content on and in connection with the Service, and to show it to other users as the feature intends. This licence ends when you delete the content or your account, except where content is included in a shareable card or link already created by a user.

The Service itself — its design, layout, text, graphics, illustrations, photographs, animations, software and database — is owned by us or licensed to us and is protected by law. You may use the Service for your own personal, non-commercial enjoyment. You may not copy, republish, sell, licence, distribute or create derivative works from any part of the Service without our written permission, except for content you yourself posted or where we offer a sharing feature for that purpose.

Distillery names, brands, bottle imagery and product names belong to their respective owners and are used for identification and descriptive purposes only. Nothing on the Service implies any affiliation, sponsorship or endorsement by a distillery unless we say so expressly.

Parts of the Service rely on third parties, including our hosting and application platform, our payment provider (Base44 Payments, powered by Wix), our subscription billing provider, and AI models used for image recognition and assistive features. Their terms and privacy policies apply to their services. We are not responsible for the acts, omissions or availability of third-party services, and their failure may interrupt features of the Service.

Where the Service links to third-party sites or partner venues, we do not control them and are not responsible for their content.

We aim to keep the Service available and accurate, but we do not guarantee that it will be uninterrupted, error-free or secure, or that any content is complete, current or free from mistakes. Features may be added, changed, suspended or withdrawn at any time, including the whole Service. Where a scheduled outage is planned, we will try to give reasonable notice.

Prices, whisky details, flight contents and venue offerings shown are indicative and may change without notice.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited by law. Your statutory rights as a consumer are not affected.

Subject to the above, and to the fullest extent permitted by law:

• the Service is provided on an "as is" and "as available" basis, without warranties of any kind beyond those implied by law;
• we are not liable for loss of profit, loss of business, loss of opportunity, or any indirect or consequential loss;
• we are not liable for the acts or omissions of venues, distilleries, third-party services or other users;
• our total liability to you in connection with the Service is limited to the greater of (a) the amount you have paid us in the twelve months before the event giving rise to the claim, or (b) £50;
• we are not responsible for any loss arising from information you relied on from the Service, including tasting notes, prices, availability or AI-generated suggestions.

You may stop using the Service at any time and may delete your account from your settings, or by contacting us. Deleting an account cancels any membership and removes the data associated with it.

We may suspend or end your access to the Service, with or without notice, where we reasonably believe these terms have been breached, where a payment has failed, been reversed or is disputed, where we are required to do so by law, or to protect the Service, other users or a venue. Where we end access for convenience and you have paid for a period in advance, we will refund the unused part.

Sections dealing with content licences, intellectual property, liability, and governing law survive the end of your use of the Service.

If you are unhappy with the Service, please contact us first so we can try to put it right. If a complaint cannot be resolved, our complaint handling will be handled in the manner required by law, and this does not affect your right to bring a claim in court or to use an alternative dispute resolution service.

These terms, together with our Privacy Policy and any terms shown with a specific feature, are the entire agreement between us about the Service and replace any earlier discussions. If any part of these terms is found to be unenforceable, the rest remains in force. A delay in enforcing a term is not a waiver of it. We may transfer our rights and obligations to another business, and we will tell you if we do. A person who is not a party to these terms has no right to enforce any part of them.

We may update these terms from time to time, for example to reflect changes in the Service or the law. The updated version takes effect when it is posted on this page, and the "last updated" date will change. Where a change is material, we will give reasonable notice — for example by notice in the app or by email. Continuing to use the Service after a change takes effect means you accept the updated terms.

These terms are governed by the laws of Scotland. Subject to the paragraph below, the courts of Scotland have non-exclusive jurisdiction over any dispute arising out of or in connection with these terms or the Service.

If you are a consumer resident elsewhere in the United Kingdom or in the European Union, you may also bring proceedings in the courts of the country or part of the United Kingdom in which you live, and nothing in these terms affects your rights under the mandatory consumer protection rules of that place.
